Workshop Juridische Aspecten AI & Data bij TNO - NL AIC Startups & Scaleups TekDelta Event

Op 24 september 2020 gaf Stanford Law School Fellow Mauritz Kop een masterclass over de juridische dimensie van kunstmatige intelligentie en informatie aan de getalenteerde deelnemers van de Werkgroep Startups & Scaleups van de Nederlandse AI Coalitie (NL AIC), in het kantoor van TNO Research in Den Haag. De workshop maakte onderdeel uit van het TekDelta | NL AIC startup accelerator event, met als centraal thema het versnellen en faciliteren van innovatie door het verbinden van startende ondernemingen met bestaande leading organisaties met slagkracht: het samen bouwen aan een succesvol high tech ecosysteem in Nederland.

Masterclass 'Juridische Aspecten van AI & Data’

De 2,5 uur durende masterclass 'Juridische Aspecten van AI & Data' bij TNO verschafte de cursisten duidelijkheid over de regels voor data delen, privacy en gegevensbescherming, alsmede juridisch en economisch eigendom van informatie. We behandelden onderwerpen variërend van de bescherming van intellectueel eigendom op het AI-systeem, de software, hardware en apps, clearance van data tot het anticiperen op de aanstaande AI & Data Governance wetten van de Europese Commissie.

Multidisciplinair Panel voor Verantwoord Data Delen

Dezelfde middag vond er vanuit het TNO gebouw een online seminar plaats speciaal voor startups, onder leiding van Anita Lieverdink, Senior Orchestrator of Innovation at TNO, Directeur van TekDelta en Program Manager van de Werkgroep Startps & Scaleups van de Nederlandse AI Coalitie.

AIRecht managing partner Mr. Kop nam als juridisch expert deel in het panel dat ging over verantwoord data delen. Het was goed om deel te nemen aan dit multidisciplinaire panel en samen met onze collega's oplossingen te verkennen voor het versneld en verantwoord delen van gegevens. Het is cruciaal en urgent om belemmeringen voor de inzet van benevolente AI weg te nemen en organisaties begeleiding te bieden die rechtszekerheid en vertrouwen in de snelle introductie van deze veelbelovende transformatieve technologie aanmoedigt!

Juridische Cursussen van AIRecht

Onze cursussen ‘AI en Recht – Juridische aspecten van AI, Machine Learning en Data’ bieden een compleet overzicht van de juridische facetten van kunstmatige intelligentie, big (structured/labelled en unstructured, raw) data en de verschillende typen machine learning (supervised, unsupervised, deep reinforcement, transfer, federated). De invalshoek is breed: van beschermen idee tot en met marktintroductie van het product. Cursusdoel is het wegnemen van juridische obstakels voor innovatie. Onderwerpen die hierbij aan de orde komen zijn privacywetgeving, het maximaliseren van uw IP-portfolio (intellectueel eigendom), normering, standaardisering (interoperabiliteit) en certificering (CE mark, keurmerken, conformiteit), het stimuleren van internationaal zakendoen, en het realiseren van (training)data delen op basis van EU regelgeving, licenties, toestemmingen en rechtsgeldige contracten. Maatwerk is mogelijk.

De workshops en masterclasses zijn cross-disciplinair en verbinden de ontwikkeling en toepassing van technologie met geldend nationaal en EU recht.

In August 2019, AIRecht managing partner and strategic IP specialist Mauritz Kop had the pleasure to be part of a pre-selected international group of highly talented IP lawyers, counsels and scholars who had the opportunity to bring their professional skills to the next level and study complex IP issues related to Silicon Valley’s hi-tech industry, during an intensive international certificate summer program on U.S. IP law. The international professional American Intellectual Property Law Program at Stanford University is co-directed by Prof. Siegfried Fina, Prof. Mark Lemley and Dr. Roland Vogl.

AIRecht presents ECP AIIA in Silicon Valley

On 23 August 2019, Mauritz Kop LL.M. had the honour to present the ECP AI Impact Assessment to front-running companies in Silicon Valley, in the amazing San Francisco Bay Area. AI should be a force for good and our Dutch risk-management tool can help with that. The AIIA is a first-of-its-kind guide for the development and implementation of artificial intelligence and includes 2 things: a practical Checklist from a legal, technical and ethical point of view (in line with the EU Trustworthy AI paradigm) and a concrete Code of Conduct for data scientists. On top of that, our AIRecht managing partner introduced the AIIA at Stanford University, in beautiful Palo Alto.

Stanford University has a stunning campus. It offers exuberant nature, nice temperature and magnificent architecture. Innovation is in the air. During the graduation ceremony of a post-doctoral intellectual property course at Stanford Law School, Mauritz officially handed over an English hardcopy of the ECP AI Impact Assessment to Professor Siegfried Fina and Professor Roland Vogl, Program Directors at SLS. The Program focusses on ‘'Overview on U.S. IP Law’ with specific attention to high-tech IP issues, such as copyrights, trade secrets, patents, trademarks, licensing and venture capital. A wonderful place for learning, discovery, innovation, expression and discourse, at the highest academic level imaginable.

Transatlantic bridges

It was an incredibly inspiring visit to Silicon Valley. We have seen it with our own eyes now: the Bay Area truly is the innovation hub of the world, together with Massachusetts (Boston, Harvard, MIT). It offers excellent opportunities for tech start-ups to work together and brainstorm with the best qualified experts, and create partnerships with professionals in myriad industrial sectors and disciplines. We hope to be back soon to further strengthen EU-USA relationships, construct new partnerships, exchange talent and remove barriers to trade and collaboration across the Atlantic.

Legal Aspects of AI in Healthcare

On 16 August 2019, Suzan Slijpen LL.M. had the honour to speak about the legal aspects of the development and use of artificial intelligence (a disruptive technology) in healthcare, at the AI in Medicine Conference organized by the Irish Association of Physicists in Medicine (IAPM). The conference took place in Galway, at the National University of Ireland (School of Physics, NUI Galway/ OÉ Gaillimh). Suzan is a senior legal consultant at AIRecht.nl, and specializes in eHealth & medical devices, pharmaceutical law, European food law and contract law, from an AI helicopterview. She is also founder and lawyer at boutique law office Slijpen Legal.

De Policy and Investment Recommendations for Trustworthy AI van de onafhankelijke High-Level Expert Group on Artificial Intelligence (AI HLEG) bevatten 33 punten, waaronder 11 key takeways die Europese Artificiële Intelligentie naar duurzaamheid, groei en competitiveness moeten leiden. Best practices en Codes of Conduct zoals het ECP AI Impact Assessment spelen in daarin een prominente rol.

Succesvolle eerste Europese AI Alliance Assembly in Brussel

De HLEG kan terugkijken op een succesvolle eerste editie van de Europese AI Alliantie Conferentie in Brussel, die gehouden werd op 26 juni 2019. Tijdens de Assembly - die ook online werd gestreamd - werden de nieuwste prestaties in het AI-beleid en de toekomstperspectieven van de Europese strategie voor kunstmatige intelligentie besproken (i.e. sociale, mensgerichte AI die fundamentele rechten en vrijheden respecteert), inclusief de impact ervan op onze economie en samenleving.

On December 3, 2018 our office Artificial Intelligence & Law delivered the lecture 'The legal status of smart robots: legal personality, intellectual property and fundamental rights'. On the occasion of the Symposium on robotisation and eHealth in the pharmaceutical industry, organized by Academy Het Dorp and Proeftuin Robotica. The central theme of this seminar on healthcare regulation was: Can you hold a robot liable in case of damages?

How should we deal with liability in robotics?

The following questions were addressed: Should robots equipped with AI have a separate legal status? How do you - as a developer/supplier and consumer/user/patient get a grip on liability for autonomous machines and artificial intelligence algorithms? How do we safeguard ethical principles and fundamental human rights? Who owns intellectual property rights in smart robots and copyrights on computer and AI generated works? How should we deal with liability in robotics?

AI Impact Assessment: checklist voor toepassing artificiële intelligentie

Het AI Impact Assessment biedt ondernemers, datawetenschappers en softwareprogrammeurs een gedragscode waarmee AI veilig geïmplementeerd kan worden. Het Artificial Intelligence Impact Assessment is ontwikkeld door het ECP|Platform voor de InformatieSamenleving. De AI Impact Assessment is een wegwijzer voor toepassing van artificiële intelligentie. Via een praktische checklist op zowel juridisch, technisch als ethisch vlak.

De uitvoering van de AI Impact Assessment wordt bij voorkeur begeleid door een daartoe gespecialiseerd jurist.

Risico-inschattingsinstrument

De AIIA vertoont verwantschap met andere risico-inschattingsinstrumenten zoals de Privacy Impact Assessment (PIA, ook wel Data Protection Impact Assessment (DPIA) of gegevensbeschermingseffectbeoordeling (GEB) genaamd). We zien eenzelfde logica terug bij de 3 Robotwetten van Asimov, de IBM Watson AI Guidelines en de 23 Asilomar AI principes. De AIIA heeft eveneens een gidsfunctie, en een vergelijkbaar moreel kompas.

Leidraad voor verantwoorde implementatie van kunstmatige intelligentie

De Artificiële Intelligentie Impact Assessment (AIIA) bevat een overzichtelijk stappenplan met 8 stappen, aan de hand waarvan bedrijven inzichtelijk kunnen maken welke juridische en ethische normen van belang zijn bij de creatie en toepassing van AI-systemen en smart robotics. Ook maken de AIIA en de Gedragscode Artificiële Intelligentie helder welke motieven en beweegredenen de basis vormen van de te maken keuzes en beslissingen tijdens het AI implementatietraject. Dit maakt het gebruik van kunstmatige intelligentie en slimme algoritmes transparanter.
